CIRCULAR 2026/13 The law numbered 7578 on the Amendment of the Social Services Law and Some Laws, published in the Official Gazette dated 01/05/2026 and numbered 33240, has come into effect with the amendments made to Articles 15 and 18 of the Law No. 5510 on Social Insurances and General Health Insurance, and additional maternity periods regulated by the Temporary Article 1.

It is stated in Article 27 of the same law that the provisions mentioned in the law will come into force as of the publication date of 01.05.2026.

In this context, amendments have been made to the relevant sections of Circular No. 2016/21 in accordance with the new legislation.

Accordingly, the amendments made in Circular No. 2016/21 dated 29/09/2016 are explained below.

The first paragraph of the article titled "5.2.1. Temporary Incapacity Benefit" has been amended as follows.

"Those included in the scope of subparagraph (a) of the first paragraph of Article 4 of the Law and the mukhtars specified in subparagraph (b) and the female insured within the scope of subparagraphs (1), (2), and (4) of subparagraph (b) and the female insured within the scope of subparagraphs (a) and (g) of Article 5 and the female insured specified in the first paragraph of Article 9 of the Law will be granted daily temporary incapacity benefits based on maternity situations.

The law numbered 7578 on the Amendment of the Social Services Law and Some Laws, published in the Official Gazette dated 01/05/2026 and numbered 33240, has come into effect with the amendments made to Articles 15 and 18 of the Law No. 5510 on Social Insurances and General Health Insurance, and additional maternity periods regulated by the Temporary Article 1.

Accordingly, the temporary incapacity benefit will be paid for each day not worked during the 8 weeks before and 16 weeks after childbirth, depending on the rest prescribed by the physician, with an additional 2 weeks added to the 8-week period in case of multiple pregnancies.

2- In the 2nd, 4th, and 13th paragraphs of the same title, the expressions "3" have been changed to "2"; the expression "three" in the 10th and 13th paragraphs has been changed to "two".

3- In the 5th paragraph of the same title, the dates in Example-1 "07/03/2014", "17/03/2014", "07/03/2014-17/03/2014" and "17/03/2014-02/05/2014" have been changed to "07/05/2026", "17/05/2026", "07/05/2026-16/05/2026" and "17/05/2026-01/07/2026" respectively; the expressions "3", "56" and "(56+10+46=112)" have been changed to "2", "112" and "(112+10+46=168 days)".

4- The expression "3" in the 12th paragraph of the same title has been changed to "2", and the expression "three" has been changed to "two".

5- The following paragraphs have been added after the 26th paragraph of the same title.

"As of 01/05/2026, the implementation regarding maternity reports that have not yet completed the postnatal rest period and those whose postnatal report period has expired before 01/05/2026 will be as follows.

a) For those whose postnatal rest period has started but not completed, the end dates of the reports of insured persons whose postnatal period has not been completed as of 01/05/2026 will be extended by 8 weeks (56 days) without any application.

b) For those whose postnatal rest period has expired before 01/05/2026, temporary incapacity benefits will be paid under maternity insurance for the days not worked, provided that they have gained the right to temporary incapacity benefits from maternity insurance, and for those insured under 4/1-(a) who have used maternity leave within the framework of the regulations made by the law numbered 7578, for up to 8 weeks.

6- In the first paragraph of the article titled "5.2.2. Conditions for Benefiting from Temporary Incapacity Benefit in Maternity Insurance", the second "8" has been changed to "16" and the sentence "(Except for the working status until 3 weeks before delivery with the consent of the insured woman and the physician)" has been removed from the paragraph.

7- In the second paragraph of the same title, the expression "3" has been changed to "2"; the expression "37th" has been changed to "38th".

8- In the third paragraph of the same title, the dates in Example-1 "03/03/2017", "07/04/2017" and "03/03/2017" have been changed to "03/05/2026", "13/06/2026" and "03/05/2026" respectively; the expressions "3" and "35" have been changed to "2" and "42".

9- In the fourth paragraph of the same title, the dates in Example-2 "10/04/2017", "24/04/2017" and "(24/04/2017)" have been changed to "10/05/2026", "31/05/2026" and "(10/05/2026-30/05/2026)" respectively; the expressions "3" have been changed to "2".

10- In the fifth paragraph of the same title, the expression "37" has been changed to "38".

11- In the sixth paragraph of the same title, the dates in Example-3 "03/03/2017" have been changed to "03/05/2026"; the expressions "56" and "63" have been changed to "112" and "119" respectively, and the expression "37 and" has been removed.

12- The seventh paragraph of the same title has been removed.
